Conditions for returning goods

According to the Law of Ukraine “On the Protection of Consumer Rights”, there are two situations of exchange or return of purchased goods:

 

1. In case of purchase of goods of inappropriate quality.

According to Article 8 of this Law, upon detection of significant defects that arose due to the fault of the product manufacturer, during the warranty period, the consumer has the right to replace the product or return money.

 

According to clause 12 of Article 1 of the Law of Ukraine “On the Protection of Consumer Rights”, a significant defect is considered to be a defect that makes it impossible or inadmissible to use the product in accordance with its intended purpose, which arose due to the fault of the manufacturer and at the same time  endowed with at least one of these features.:

a) it cannot be eliminated at all;

b) it takes more than fourteen calendar days to eliminate it;

c) he makes the goods significantly different from what is provided for in the contract.

 

If it is necessary to check the quality of the product, an examination by a certified laboratory can be carried out, during which the fact of violation by the consumer of the terms of use of the product is established. According to Clause 4 of Article 17 of the Law of Ukraine “On the Protection of Consumer Rights”, the examination is organized within three days from the day of receipt of written consent from the consumer for examination of products. If, according to the results of the examination, it is proven that the defects arose after the goods were handed over to the consumer and subsequently by the consumer’s violation of the rules of use, storage and transportation, the consumer’s claims cannot be satisfied, and the consumer is obliged to reimburse the costs of the examination.

 

The consumer’s request for replacement of the product is subject to immediate satisfaction if it is available, and in case of its absence – within two months from the moment of submission of the application. If it is impossible to satisfy the demand within the established period, the consumer has the right to demand the replacement of the defective product with another good quality product with a corresponding price change or refund. Consumer requests for a refund must be satisfied within seven days. Settlement with the consumer in the event of an increase in the price of the product is based on the value of the product at the time of its purchase.

 

2. Purchase of goods of appropriate quality, but if the goods for some reason did not suit the buyer.

According to Article 9 of the Law of Ukraine “On the Protection of Consumer Rights”, the consumer has the right within 14 days to replace the product of appropriate quality with a similar one, if the product did not meet the required parameters, but on the condition that the product was not used and its appearance, consumer properties were preserved, seals, packaging, documents.

 

If, at the time of the exchange, a similar product is not on sale, the consumer has the right to purchase any other product, or to receive money back in the amount of the value of the returned product, or to exchange the product for a similar product at the first arrival of the corresponding product for sale. When returning money, settlements with the consumer are carried out based on the value of the product at the time of its purchase. Money is returned within seven days.

 

The consumer’s requirements are considered only after clarifying the customer’s name and order number, complete set of goods, packaging with a bar code. Product replacement or refund is possible only if all conditions and procedures are followed.

 

You will be denied a product replacement or refund if:

• a product that does not have significant defects, but was used;

• more than 14 days have passed since the purchase of the goods;

• when checking the quality of the product, signs of tampering (opening, use) or other conditions are violated (transportation, storage);

• there is no document confirming the purchase of the product.

 

We also draw your attention to the fact that according to Clause 3 of Article 4 of the Law of Ukraine “On the Protection of Consumer Rights”, the consumer is obliged to:

1) before starting use, carefully familiarize yourself with the rules of use outlined in the online store and on the product label;

2) if it is necessary to obtain an explanation of the conditions and rules for the use and storage of the product – before starting to use the product, contact the seller for clarification;

3) use the product according to its intended purpose and comply with the conditions (requirements, norms, rules) established by the manufacturer of the product in the regulatory documentation;

4) in order to prevent negative consequences for the consumer regarding the use of the product – follow the safety methods provided by the manufacturer in the product and the special rules provided by the regulatory documentation, and in the absence of such rules in the documentation – follow the usual understandable safety methods established for products of this type.

 

The return and replacement of goods sent by the online store “sporysh.com.ua” to various cities of Ukraine is carried out by the buyer returning the goods by delivery services, in particular “Nova Poshta”.

The return of money is carried out by cash on delivery. The postal service undertakes to release the cargo only after payment by the recipient of the declared value. This amount is transferred to the sender. This amount must correspond to the value of the returned product. Before sending the goods, the buyer must contact the store manager, discuss the terms of shipment and determine the name of the recipient of the goods, the address of the delivery service department.

In the event that the reason for the return or replacement was the improper quality of the product, the Seller will pay for the return shipment.

If the purchased goods were of proper quality and the buyer picked them up from the Nova Poshta delivery point (did not refuse after inspection at the delivery point), but for some reason the product did not fit the buyer within 14 days from the moment of receipt, then the return shipment, as well as the remittance of money ( after payment) is made by the buyer.
